Հոդվածում ներկայացվում են ԵՄ-Հայաստան Համապարփակ և ընդլայնված գործընկերության համաձայնագրի (ՀԸԳՀ) իրավական վերլուծությունն ու դրա հնարավոր ազդեցությունը Հայաստանի իրավական համակարգի վրա: ՀԸԳՀ-ն եզակի իրավական գործիք է, քանզի դրա ստորագրող կողմը միաժամանակ Արևելյան գործընկերության (ԱլԳ) և Եվրասիական տնտեսական միության (ԵԱՏՄ) անդամ երկիր է: ՀԸԳՀ-ն զգալիորեն տարբերվում է Գործընկերության և համագործակցության համաձայնագրերից (ԳՀՀ), որոնք կնքվել են հետխորհրդային երկրների հետ 1990-ական թվականներին և նոր սերնդի Ասոցացման համաձայնագրերից (ԱՀ), որոնք ստորագրել են Վրաստանը, Մոլդովան և Ուկրաինան:
This article provides the legal analysis of the newly signed EU-Armenia Comprehensive and Enhanced Partnership Agreement (CEPA) and characterizes its potential influence on the Armenian legal system. In particular, the author focuses on CEPA’s place in the domestic legal order (with specific attention paid to the status and the mechanisms of implementation of the binding decisions of the institutions established by the Agreement), the institutional framework of partnership under CEPA, essential elements and conditionality mechanisms of the Agreement, as well as mechanisms of legislative approximation to the EU acquis. Being signed with a country-participant of the Eastern Partnership (EaP) which, at the same time, is a member of the Eurasian Economic Union, CEPA is a unique legal instrument.
