Abstract:

Հոդվածում դիտարկվում են Արևմտյան Եվրոպայի երկրներում օրենսդրության բարելավման նպատակով հաջողությամբ օգտագործվող հետօրենսդրական վերահսկողության համակարգի կիրառման հնարավորությունները հետխորհրդային տրանսֆորմացիայի գործընթացում գտնվող երկրներում կիրառման տեսակետից։ Այդ երկրներում համակարգի կիրառման հաջողության համար կարևորվում է խորհրդարանի կարգավիճակի առանցքային նշանակությունը և երկրների առանձնահատկությունները հաշվի առնելը։ Ցույց է տրվում, որ Մոլդովայում համակարգի կիրառման փորձի անհաջողության պատճառները պայմանավորված են այդ առանձնահատկությունները հաշվի չառնելու հանգամանքով։ Դիտարկվում են Հայաստանում համակարգի կիրառման նախադրյալներն ու հնարավորությունները։
The article analyzes the possibilities of applying the system of post-legislative scrutiny in the post-Soviet states, which is successfully used in the Western European countries for the improvement of legislation. In the post-Soviet states, the status of the parliament and the particular features of the states are important for the successful functioning of the system. It is shown that the failure of this system in Moldova is due to the fact that these features have been sidelined. The article also studies the prerequisites and possibilities of the application of this system in Armenia.
