Abstract:

В статье рассматривается политическое влияние конституционных изменений в постсоветских странах за последние 25 лет. Проанализированы и систематизированы все конституционные поправки, принятые в постсоветских государствах в целях обеспечения баланса конституционных полномочий в меняющихся социальных условиях. Классифицированы все изменения на основе формальных юридических критериев и по совокупности критериев, предложенных политологами. Выявлены реальные и потенциальные конфликты между ветвями власти, которые могут быть спровоцированы примененными формами и методами конституционного пересмотра. Проведен подробный анализ институтов, вовлеченных в процесс изменений, их обсуждения и принятия, а также формальных и неформальных процедур внесения изменений в процесс. Использованы методы сравнительноправовых исследований и когнитивного конституционализма. Раскрытие реальных мотивов пересмотра Конституции, правовых и политических форм и технологий обеспечивает возможность надежного объяснения неоднозначных тенденций конституционной реформы, достижений, неудач и подводных камней политической трансформации. Он открывает путь к полноценной конституционной инженерии, независимого конституционного контроля и возможности прогнозирования перспективных политических тенденций “новых демократий” на постсоветском пространстве.
The article examines political effect of constitutional changes in post-Soviet states during the last 25 years. All constitutional amendments adopted in post- Soviet states are analyzed and systematized to ensure the balance of constitutional powers in changing social conditions. The article introduces the classification of all amendments on the basis of formal juridical criteria and on the set of criteria proposed by political scientists, as well as reveals the real and potential conflicts between branches of power which could be provoked by the applied forms and methods of constitutional revision. The article makes a detailed analysis of institutes involved in the process of amendments discussion and adoption, as well as formal and informal procedures of the amendment process. The methods of comparative-legal studies and cognitive constitutionalism are being used. The revelation of real motives of constitutional revision, legal and political forms and technologies provides the possibility of reliable explanation of ambiguous constitutional reform trends, achievements, failures and pitfalls of political transformation. It opens the way for the fullfledged constitutional engineering, independent constitutional monitoring and the possibility to forecast the prospective political trends of “new democracies” in post-Soviet space.
