Abstract:

В широком контексте философии права и конституционного опыта автор реконструирует историческую роль Российской Конституции 1993 г., показывая значение ее основных принципов и циклическую динамику их реализации в постсоветский период. Его интерпретация противоречий правовых норм и политической практики основана на важных новых эмпирических исследованиях и демонстрирует неустойчивое равновесие демократических и авторитарных тенденций в современной России. Статья раскрывает основные области конституционных дисфункций, возможные стратегии и технологии дальнейшей конституционной модернизации.
In the broad context of the national and international legal philosophy and constitutional experience the article reconstructs the historical role of the Russian Constitution of 1993 showing the meaning of its basic principles and cycling dynamic of their realization in the Post-Soviet period. His interpretation of the contradiction between legal norms and political practices is based on the important recent empirical investigations and demonstrates the unstable balance between democracy and authoritarianism in contemporary Russia. The article represents main areas of the current legal dysfunctions, possible strategies and technologies of the further constitutional modernization.
