Abstract:

Հոդվածի նպատակն է բացահայտել «Ցեղասպանության հանցագործությունը կանխարգելելու և պատժելու մասին» կոնվենցիայի կիրառման հնարավորություններն ու դժվարությունները: Հոդվածում նաեւ ներկայացվում են այն խնդիրները, որոնք դրսևորվել են 1990-ականներին եւ դրանից հետո, մասնավորապես Ռուանդայում եւ Հարավսլավիայում տեղի ունեցած ցեղասպանական գործողությունների հետեւանքով ստեղծված միջազգային տրիբունալների աշխատանքում՝ այդ նորմերը մեկնաբանելու եւ դրանց արդյունավետ կիրառումն ապահովելու ուղղությամբ: Բացահայտվում են այն օբյեկտիվ և սուբյեկտիվ դժվարությունները, որոնք առաջանում են կոնվենցիայում օգտագործված սահմանումների հետ կապված: Դիտարկվում են 2020թ. Արցախի հանրապետության դեմ իրականացված ադրբեջանաթուրքական ագրեսիայի ընթացքում Թուրքիայի եւ Ադրբեջանի գործողությունները՝ Կոնվենցիայի համաձայն ցեղասպանության փորձ որակելու համատեքստում:
The aim of the article is to identify the opportunities and difficulties of implementing the “Convention on the Prevention and Punishment of the Crime of Genocide”. The article highlights the challenges posed by the activities of international tribunals set up in the 1990s and beyond. It particularly focuses on the Tribunals for Rwanda and Former Yugoslavia, to interpret those norms and ensure their effective application. The article also reveals the objective and subjective difficulties arising from the definition sused in the Convention. Further it considers the actions of Turkey and Azerbaijan during the 2020 Azeri-Turkish aggression against the Republic of Artsakh in the context of qualifying them as the attempt of genocide under the Convention.
