Abstract:

Հոդվածը ներկայացնում է ազգերի ինքնորոշման իրավունքի հիման վրա ձևավորված պետությունների կայացման խնդիրները, ինչպես նաև դրանց կապը միջազգային ճանաչման հետ։ Ներկայացվում են Մոնտեվիդեոյի Կոնվենցիայում ամրագրված պետության իրավասուբյեկտությունը որոշող հատկանիշները՝ որպես պետության կառուցման և կայացման գործընթացների հիմք, այդ չափանիշների կապն ազգերի ինքնորոշման իրավունքի հետ, ինչպես նաև միջազգային իրավունքի շրջանակներում վերոնշյալ չափանիշների վերլուծությունը Լեռնային Ղարաբաղի և Կոսովոյի օրինակով: Չկայացածության և չճանաչվածության կապի կամ կապի բացակայության ուսումնասիրության նպատակով հոդվածում ներկայացվում են վերոնշյալ կապի կամ դրա բացակայության առանձնահատուկ մարտահրավերներն ըստ պետության կայացածության ոլորտների՝ քաղաքական, տնտեսական, սոցիալական և անվտանգության:
The article discusses the stateness issues of states emerged on the selfdetermination principle, as well as the latter’s connection to international recognition. It represents the requirements for legal personality of states - codified in Montevideo Convention on Rights and Duties of States as the basis for the processes of state-building and stateness, the link of these criteria with the right of peoples to self-determination, as well as analysis of the afore-mentioned criteria within the international law on the examples of Kosovo and NKR, The article, aiming to present the connection or the lack of connection between non-recognition and state fragility and/or failure, represents the specific challenges of the afore-mentioned connection or its lack according to stateness fields: political, economic, social and security.
