Abstract:

Правовые нормы, закрепленные в международно-правовых актах по урегулированию социально-семейных отношений, противоречат нормам национального законодательства ряда европейских стран, а Европейский суд по правам человека в своих решениях по-разному трактует положения Конвенции. The legal norms enshrined in international legal acts on the regulation of social and family relations contradict the norms of the national legislation of a number of European countries, and the European Court of Human Rights in its decisions differently interprets the provisions of the Convention. Former non-existent legal relations are formed, same-sex marriages are allowed, and in some conservative Catholic countries, prisoners are also able to exercise this right.
