Հոդվածում ուսումնասիրվում է ազգերի ինքնորոշման իրավունքի կիրառմամբ ձևավորվող պետությունների միջազգային ճանաչման գործընթացը, մասնավորապես, քաղաքական պետական պրակտիկայի և նորմատիվային միջազգային իրավունքի բախման խնդիրները: Այդ գործընթացն առաջարկվում է դիտարկել որպես երեք փոխկապակցված փուլերի՝ անկախ պետության հռչակում, միջազգային ճանաչում և կայացում, միջանկյալ հատված: Առաջարկվում է Մոնտեվիդեոյի կոնվենցիայով սահմանված պետության չափանիշների այնպիսի մեկնաբանություն, որը հաշվի է առնում գործընթացի իրավական և քաղաքական բաղադրիչների առկայությունն, ինչպես նաև բացատրում է պետության հռչակումից մինչև միջազգային ճանաչում ընկած ժամանակահատվածի տևականության պատճառները: Դիտարկվում են ինքնորոշման իրավունքի հիման վրա հռչակված պետությունների ճանաչման գործընթացներ՝ վերլուծելով մի շարք վիճելի դեպքեր՝ սկսած Հարավսլավիայի փլուզումից հետո Բադինտերի հանձնաժողովի ներկայացրած կարծիքից:
The article discusses the process of international recognition of states emerged on the rights of peoples to self-determination, particularly, the issues of collision between political state practice and normative international law. This process is proposed to be viewed within three interconnected phases – the declaration of independence, international recognition and stateness process. The article represents a rendition of criteria enshrined in the Montevideo Convention on Rights and Duties of States, which takes into account the existence of legal and political factors of international recognition, as well as explains the reasons for longevity of the period between the declaration of independence and international recognition. The processes of recognition of the states emereged on the basis of selfdetermination are reviewed, analyzing a number of disputable cases starting from the opinion submitted by the Badinter Commission after the collapse of Yugoslavia.
