Abstract:
The international community has repeatedly faced gross violations of the rights of peoples: cases of mass atrocities, violence, ethnic cleansing, genocide. Numerous instances of humanitarian intervention to avoid such violations and challenges for international security have never been unequivocally acknowledged by the international community. The differencein approaches is due to the fact that the humanitarian intervention has always been considered in parallel with the principles of non-use of force, noninterference in the internal affairs of states, and sovereign equality of states. To overcome the obstacles, the report of the International Commission on Intervention and State Sovereignty (R2P) popularized a new concept of Responsibility to Protect as a set of three responsibilities: the responsibility to prevent, to react, and to rebuild. Despite the attempt to create a legal basis for up to the military intervention with the responsibility to protect, cases o finterference in international relations pursuing other goals under the guise of protecting human rights reveal the incompleteness of the process and the shortcomings of the legal basis.
