Abstract:

Դատական համակարգի ձևավորումը և կայացումը հետխորհրդային տրանսֆորմացիայի երկրների ամենաբարդ և առանցքային խնդիրներից մեկն է: Այն վերջին մակարդակն է, որտեղ կարող են վիճարկվել պետական մարմինների որոշումները՝ ապահովելով մարդկանց իրավունքների և ազատությունների պաշտպանությունը և պետական մարմինների նկատմամբ վստահությունը: Արդարադատության արդյունավետ իրականացման հիմքը դատական համակարգի գործունեության հիմնական սկզբունքների՝ դատավորների անկախության, անկողմնակալության, անհրաժեշտ վարձատրության ապահովումն է: Հետխորհըրդային տրանսֆորմացիայի երկրների դեպքում դրա հիմնական խոչընդոտներն են այլ սկզբունքների վրա հիմնված դատական համակարգի ժառանգությունը, համապատասխան մշակույթի և ավանդույթների բացակայությունը:
The formation and consolidation of judicial system is one of the most complicated and core issues facing post-Soviet transformation states. It is the last instance where the decisions of the state authorities can be appealed ensuring the protection of human rights and liberties and the trust in state authorities. The independence and impartiality of the judges as well as the insurance of their remuneration constitute the basis of good administration of justice. In post-Soviet transformation states the main obstacles to this are the legacy of judicial system based on other principles, the lack of appropriate culture and traditions.
