In this work there is a reference to the exercise of adversarial approach in one of the procedural branches of law-criminal procedure. Taking into consideration, that numerous subquestions concern the issue under discussion in legal literature and judicial practice, the author discusses only whether the principle is applied to the stages o f preliminary investigation. Substantiating the necessity of full application of that principle in pre-trial stages, suggestions that correspond to contemporary legal thinking and based on the concept of the new RA Criminal Code are made concerning the improvement of legal norms regulating the principle.
